In the area of regulation of foreign direct investment, our U.S. and Canadian lawyers have provided clients with a full range of advice regarding bilateral and multilateral investment treaties, such as disputes commenced under Chapter 11 of the NAFTA and reviews by the Committee on Foreign Investment in the United States (CFIUS). We have also advised governments at national and sub-national levels on issues of liability and litigation strategy in investment arbitrations.

Our Brussels team advises clients on navigating the complex EU regulatory environment, with particular focus on the EU’s latest climate measures — including the Carbon Border Adjustment Mechanism (CBAM), Emissions Trading System (ETS), Renewable Energy Directive, and others — as well as mandatory due diligence obligations (for example, the Corporate Sustainability Due Diligence Directive, the Forced Labour Regulation, the Deforestation-free Regulation, the Batteries Regulation, and regulations governing conflict minerals) as well as the EU’s Generalised Scheme of Preferences.
